Question about calling the police

    Okay Marshall I have a question for ya. I live in SoCal in an okay city. But I live in a horrible apartment complex (alot of drugs, drinking, partying every night, illegal immigrants). I have a question of when should I call the police? If people are playing their music extremely loud from 10pm-3am if I make a call to the police (I call their non-emergency line) they either don't come by or by the time they come (hours later) the music is off and they have moved the party inside. Should I call the police when they are doing these things or should I just look the other way and let it go figuring I wont be living in this place for long?

    Here goes......When we get calls they are prioritized. A music call unfortunitly will not get a high response. We respond to alot of domestic violence calls at all times of the day and this type of call will receive a higher response. Also a music call is always a 2 or more unit call. Most of the time the people who call do not want to get involved as they do not want their neighbors to get pissed off at them. This presents a problem as this limits our enforcement action. The law says an Officers peace can not be disturbed so we can only respond to a music call if someone else's peace is disturbed. If the people at the party call say "Go to hell cops," then without someone willing to sign a private persons arrest then we have no real enforcement options.

    To try to explain the law a little better we can only make an arrest for a misdemeanor if it is committed in our presence or if a Private persons arrest (Often call a citizens arrest), is done. There are some exceptions to the rule when it comes to juveniles, DUI, and domestic violence. When it comes to felony we are allowed to arrest when committed in our presence, or we have probable cause to believe the felony has been committed. This allows us to arrest based on someones statements or it we have reason to believe a crime has occurred.

    You should call the police anytime you want us to come out. A persons peace can be deisturbed anytime of the day..not just after 10 PM as some people believe. Call allof the time because even if we can not arrest people for that crime many people have warrants or other things they can go to jail for.     Also real quick answer to the illegal imigrants referrence above. I am often asked this question so I would like to take a moment to explain a very hot topic. We can not check the immigration status of person as officers. The reason for this is if we did that then illegal immigrants would never call the Police, thus they would just be victims and the criminals would have no recourse against them.

    When a suspect is taken into custody the courts are supposed to check their immigration status. If they are here illegally they are supposed to be deported and denied citizenship. This is where we run into two problems. One the courts do not always check the suspects status and our boarders are wide open. I will stop this response now as it will get to be many pages long if I continue on. :cool:

    Hmmm I usually cover the abilty to search vehicles and not look for things like modifications. I will look this one up the viehicle code book tomorrow.

    As far as modified exhaust the vehicle code does say that no modification can be done to vehicles in California unless used as an off road vehicle. Hydrualics or air suspensions are not allowed and are considered unsafe vehicles under 24002 VC. After market mufflers are also illegal but unless they are loud we usually do not care. As alot of people know I love muscle cars and I am a car fanatic.

    Sorry but you have stumped me on a technicality on the vehicle code. As I do in the field when I do not know an answer (100% sure) I look up to section in the code book. I will have to answer this tomorrow, but I believe it is going to fall under the same law that allows us to search once we see something illegal in a vehicle. I am just curious regarding the scope of our authority on the search.

    Info only to my friends here. My department had 4 openings for Segeant and held a test last Tuesday. I took the test just for the fun of and relied just on my knowledge. As it turns out I am one of 5 Officers who passed the test. There is still another test to take but if I pass it and come out in the top 4 I will probably make Sergeant.

    This is unusual as I will be only the second Officers in our department to ever go from a slick sleeve (no rank) straight to a Sergeants rank. This is never heard of and the only other officer to do this is now our Assistant Chief.
